Scott Peterson death penalty sentence got overturned by the Supreme Court of California, “who was found guilty of murdering his pregnant wife” in a highly publically known case, based on judicial error.

In the year 2004 Scott Peterson, 47, was convicted of one count of first-degree murder for killing his wife, Laci Peterson who was nearly 8 months pregnant at that time. Thus, he was automatically convicted by the California Supreme Court of one count of second-degree murder for killing his unborn son.

On Christmas evening 2002 Laci Peterson, 27, got suddenly disappeared. After so long in April 2003 Laci’s and her unborn sons’ dead body was found in San Francisco Bay.

Investigators said that Peterson dumped the body of his wife and unborn son, Connor, from his fishing boat into San Francisco Bay.

The trial of Peterson was flawed for multiple reasons. The Court said the beginning was with the unusual amount of pretrial publicity that surrounded the case. Court also said we reject Peterson’s claim that he received an unfair trial as to guilt and thus affirm his murder conviction.

After determining the trial court’s “erroneously dismissed” prospective who said that they opposed the death penalty l, even though the jurors no indication that their views would prevent them from following the law, the court said it was required to revise the death sentence.

We are very grateful for the unanimous recognition of the California Supreme Court that if the state tries to put someone to death, it must proceed to trial only with a fairy selected jury.” Cliff Gardner, Scott Peterson appellate attorney, said in a written statement.

Laci Peterson’s mother, Sharon Rocha declined to comment on the decision. Along with her, The Stanislaus County District Attorney’s Office also declined to the comment.

Laci Peterson was last seen in Modesto at her family home, California. On December 24, 2002, Scott Peterson reported his wife’s missing report in the police station.  Meanwhile, his mistress, Amber Frey, secretly worked with police to help in convicting him. A unanimously jury found Peterson guilty of murdering his wife and unborn son because of which a judge sentenced him to die by lethal injection. Peterson has since remained behind the bars on death row at the San Quentin State Prison.

In a documentary series of 2017 A&E, The Murder of Laci Peterson, Scott Peterson described the moment he heard his guilty verdict. He said it was very crazy, just this amazing physical reaction I had. He said I could not feel my feet on the floor. I couldn’t even feel the chair on which I was sitting. I found everything blurry around me. My vision got a little blurry.

California’s last execution was in the year 2006. Under Government Arnold Schwarzenegger. Last year, the Government Gavin Newsom issued a moratorium on execution while he is in office.
